Nevada Assembly Bill: AB 521 Removal From Classroom |

521 allows for the removal of a disruptive student from a classroom by
the teacher, if the student is not in special education. If the
teacher removes the student from the class, the student will be placed
in an alternative setting away from other students. Parents must
be notified of the action within 24 hours by the principal. A
conference with the parents, the student, the teacher and the principal
must take place within 3 school days of removal.
At this conference, the teacher must provide the student and parents with an explanation of the reason for removing the student from the classroom. The student and parents must have an opportunity to respond. The principal shall determine if the child should be returned to the classroom or an alternative placement. If the decision is made to return the student to the classroom and the teacher disagrees with that decision, the site Behavioral Committee will review the case and a decision will be made. The following is a general list of steps that must be taken prior to the removal of a child for behavioral reasons, in accordance with the authority vested in the teacher per AB 521. The classroom teacher will document in writing the completion of each step. Please note that the order and frequency will be determined by the severity of the behavior, as well as the teacher's judgment. Also, depending on the severity of behavior and the judgment of the teacher, the principal may become involved in the process sooner than level 3.
